Terms & Conditions
1. Nature of Bid
Each bid submitted through the platform represents a genuine and formal offer to purchase the relevant artwork.
If your bid is selected and accepted by FoLA, you agree to purchase the artwork at the confirmed bid amount and to complete the required payment and related arrangements.
All bids should be submitted carefully. Once submitted, a bid may not be withdrawn, changed, or cancelled unless FoLA agrees in writing.
2. Hidden Bid System
FoLA may operate a hidden bid system. Your bid amount will not be publicly displayed to other participants.
FoLA will review bids based on relevant factors, including but not limited to the bid amount, artwork details, collector information, delivery arrangements, and the purpose of the related charity initiative.
The highest bid may not necessarily be selected. FoLA reserves the final right to accept, reject, or cancel any bid at its discretion.
3. Bidder Information
You must provide true, accurate, and complete information when submitting a bid, including your name, email address, phone number, and location.
FoLA may request further information where necessary to verify your identity, payment ability, delivery arrangements, or other matters relating to the transaction.
FoLA reserves the right to reject or cancel a bid if the information provided is incomplete, inaccurate, misleading, or cannot be verified.
4. Bid Confirmation
After submitting a bid, you may receive an automatic confirmation or email confirming that your bid has been received.
Such confirmation does not mean that your bid has been accepted, nor does it create a completed transaction.
If your bid is selected, FoLA will contact you through the email address you provided to confirm payment, delivery, and any other relevant arrangements.
5. Payment
If your bid is accepted, you must complete payment within the timeframe specified by FoLA.
If payment is not completed within the required timeframe, FoLA reserves the right to cancel your bid and offer the artwork to another collector or make other arrangements.
Unless otherwise stated, bid amounts do not include shipping fees, insurance, taxes, duties, customs charges, or other delivery-related costs. Such costs will be confirmed separately depending on the artwork size, destination, and delivery method.
6. Artwork Information and Condition
FoLA will make reasonable efforts to provide accurate artwork information, including title, artist, dimensions, medium, year, images, and relevant descriptions.
However, artwork images are for reference only. Actual colours, textures, dimensions, or condition may vary due to photography, screen display, lighting, or other factors.
You are responsible for reviewing all artwork information carefully before submitting a bid. If you have any questions, you should contact FoLA before placing your bid.
7. Delivery and Collection
FoLA will assess delivery arrangements based on the location you provide.
Artwork will be delivered or collected after payment has been confirmed and according to the arrangements agreed between FoLA and the collector.
Delivery times may be affected by location, logistics, weather, customs, or other factors beyond FoLA’s control. FoLA will make reasonable efforts to assist with safe delivery but shall not be liable for delays or issues caused by third-party service providers or circumstances beyond its reasonable control.
8. Charity Purpose
You understand and agree that bids submitted through the platform are intended to support FoLA’s related charitable or community initiatives.
After deducting necessary costs and any clearly stated expenses, proceeds will be used to support the relevant charitable purpose.
FoLA will make reasonable efforts to ensure that fund allocation is handled with clarity, transparency, and care.
9. Cancellation, Rejection, or Withdrawal
FoLA reserves the right to reject, cancel, or withdraw any bid, transaction, or artwork at any time, including but not limited to where:

the information provided is incomplete, inaccurate, or unverifiable;

FoLA suspects error, misuse, fraud, or improper conduct;

there is an obvious error in artwork information, pricing, or system operation;

the artwork is damaged, lost, unavailable, or cannot be delivered;

FoLA considers that cancellation is in the best interests of the artist, donor, collector, beneficiary, or platform.
10. Non-transferability
Unless FoLA gives prior written consent, bids and any related purchase rights may not be transferred to any third party.
11. Personal Data
Personal data submitted by you will be used for handling bids, communication, payment, delivery, and related administrative purposes.
FoLA will handle your personal data in accordance with its Privacy Policy.
12. Limitation of Liability
To the fullest extent permitted by law, FoLA shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from or relating to the bidding process, platform use, artwork information, payment, delivery, system interruption, or third-party services.
13. Updates to These Terms
FoLA may update these Terms & Conditions from time to time. Updated terms will take effect once published on the website.
Your continued use of the platform or submission of bids after any update means that you accept the revised Terms & Conditions.
14. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Hong Kong.
Any dispute arising from or relating to these Terms & Conditions or the bidding process shall first be resolved through good faith discussion. If the dispute cannot be resolved, it shall be submitted to the courts of Hong Kong.
15. Language
These Terms & Conditions may be provided in English and Chinese. In case of any inconsistency, discrepancy, or conflict between the English and Chinese versions, the English version shall prevail.
